Q. Do I get to choose the closing attorney?
A. In a sale situation this depends on the contract between the two parties. Most contracts have a specific clause which states which party gets to choose the closing attorney. Many contracts will include a closing attorney as one of its stipulations. If you are refinancing you simply need to let the lender know that you have one you want to use and it should not be a problem.
Q. Why should I use an attorney if there is not mortgage company involved?
A. There are a number of reasons to use an attorney for this situation. You want someone to make sure all documents are properly prepared and executed. Also what seems like a simple process can turn into a number of questions and problems involving things such as title problems and contingencies as well as a number of other possible unexpected issues. Please remember that whether you are the buyer or seller this is an important transaction and you do not want it done incorrectly.
Q. I am thinking of buying or selling my house. When should I contact an attorney?
A. If you are a potential buyer and you think you are going to make an offer or if someone has made you an offer and you wish to get it finalized you should seek out a closing attorney. If a real estate agent is involved you want to let him or her know if you have a closing attorney you would like to use. If there is no agent involved you want to have a legal binding contract prepared covering all bases of the transaction. A good closing attorney will help you work out all potential issues that may arise and include them in the contract before is is executed by both parties.
